This is an interlocutory appeal against the ruling of the Court of Appeal refusing the appellant's application to amend its notice and grounds and consequently amend its brief of argument. The appellants as defendant in the lower court were sued for N500,000 damages for wrongfully dishonouring the plaintiffs! respondents cheques even though it had money in its account. The proposed amendment by the appellant was to contend that the entire proceedings before the lower court leading to a controversial award of N500, 000,000 damages and the signed writ of execution for N2, 886,769.60 were a nullity.
